The Contractor shall perform the Services in compliance with this Agreement and all applicable laws.If the client has any requests or special requirements that they wish to be contained in the products, the client must inform the contractor via email or on this agreement before the booking date.The payment must be paid in full upfront.2. Cancellation
If the Client cancels the order for Services:- Less than 1 week before the Services are commenced, the payment shall be forfeited in full by the Contractor and this Agreement immediately terminated, and neither party shall have any further right or claim against the other.3. Access
The Client shall give the Contractor access to the property as necessary to enable performance of this Contract.4. Usage rights and copyright
Copyright: All photographs and videos remain the exclusive property of the contractor. The Client may not sell, redistribute or claim the products as their own work.Client Licence: The Client receives a non-exclusive licence to :- Personal use (sharing with family / friends, social media, printing for personal display)- Personal website / blog use with photographer credit- Commercial purpose (only social media, website use, advertising campaigns, duration of use, geographic limitations)NOT permitted without written permission :

Resale or licensing to third parties- Entry into Competitions- Publication (except personal social media and commercial purposes above)- Removal of watermarks or metadata5. Model release
Marketing Use: The Photographer may use images from this session for :- Portfolio display- Website and social media promotion- Advertising and marketing materials- Publication on website6. Liability Limitations
Photographer’s Liability : Not responsible for missed shots due to :- Schedule disruptions, uncooperative subjects, venue restrictions, and equipment failure beyond the photographer’s control
Not responsible for photos ruined by :- Other photographers’ flash, poor venue lighting, venue restrictionsNot liable for images lost due to :- Card failure, computer malfunctions, theft (though the photographer maintains backup systems)Total liability limited to amount paid for services7. Delivery timeline
-Image Delivery : Turnaround time 1 – 2 weeks from the event date for photos and 2 – 3 weeks for videos-Resolution : High-resolution JPEG photos. 1920 x 1080 1080p or 3840 x 2160 4k for video*Raw files are not provided-File retention : Images stored for 6 months, after which backup deletion may occur8. Termination
This Agreement may be terminated by agreement between the parties in writing.9. Definitions
In this Agreement, unless the context otherwise requires, expressions used shall have the meaning so defined or explained below:• “Services” means all the work and services necessary to perform this Contract in accordance with its terms;10. Defects after completion
The Contractor shall, without cost to the client, make good any defects or omissions in the Services which become apparent within 14 days of the Services' completion.If there are any such defects or omissions, the client shall, as soon as possible and within the 14-day period, give the Contractor written notice to make good such defects or omissions and shall give the Contractor reasonable access for that purpose. The Contractor shall make good such defects or omissions within 28 days of receiving the client’s notification.
The Contractor’s liability under this clause is limited to re-editing photos or videos. Importantly, those products must not be published on any social media or any other platform. Once a client uploads the products on social media or any other platform, the contractor shall not take any responsibility or warranty, as the contractor will assume that the client is satisfied with the products. The Contractor shall not be liable for any indirect or consequential loss arising from the supply of the Services.11. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantees or rights available under the Australian Consumer Law (ACL).12. Dispute resolution
The terms of this Agreement are governed by the laws of Queensland, Australia.
Any dispute between the Client and the Contractor arising under or in connection with this Agreement may, in the first instance, be referred to a mediation service, and failing that, to the Queensland Civil and Administrative Tribunal (QCAT).13. Contact
